General Terms and Conditions of Ritterturnier Kaltenberg Veranstaltungs GmbH (RKV)

1. Scope

  1. These General Terms and Conditions apply to all contracts for the purchase of admission tickets, gift certificates, and other passes for events organized by Ritterturnier Kaltenberg Veranstaltungs GmbH (RKV).
  2. In addition, the respective event-specific visitor guidelines apply. 
  3. If external service providers are used for the technical processing of ticket sales, their terms and conditions shall apply in addition, to the extent that they relate exclusively to the technical execution of the ordering process.

2. Conclusion of contract

  1. The listing of events and tickets does not constitute a legally binding offer.
  2. Upon completion of the ordering process, the customer submits a binding offer to purchase the selected tickets.
  3. The contract is not concluded until RKV or the ticket service provider it has appointed sends the order confirmation.
  4. If the desired number of tickets is no longer available, no contract will be formed.
  5. RKV reserves the right to limit the number of tickets per customer, household, or event.
  6. RKV reserves the right to cancel orders if ticket restrictions, visitor conditions, or other requirements are violated, or if there is suspicion of misuse of the ticket sales system.

3. Prices and Payment

  1. The ticket prices listed at the time of the order apply.
  2. In addition, service, shipping, processing, or payment fees may apply. These will be displayed during the ordering process.
  3. There are generally several payment methods available. The available payment methods are displayed during the checkout process.
  4. For SEPA direct debits, the customer is responsible for ensuring that there are sufficient funds in their account.
  5. If the customer or the customer's bank cancels the payment, RKV is entitled to block the tickets in question. 
  6. The customer is responsible for any costs and fees incurred as a result of chargebacks or other reversed payments, to the extent that the customer is at fault.
  7. In the event of chargebacks after the event has begun, the claim will be referred to a collection agency for further processing. 
  1. RKV is also entitled to block tickets if there are any outstanding balances from the customer’s previous business relationship with the company.

4. Delivery and Ticket Provision

  1. Tickets are either provided digitally, mailed, or picked up at a ticket pickup location.
  2. RKV is entitled to reissue digital tickets or choose an alternative method of delivery if this is necessary for technical or organizational reasons.
  3. The customer is required to check the tickets for accuracy immediately upon receipt. Any apparent errors must be reported immediately upon discovery, but no later than before using the service or before entering the event for the first time.

5. Ticket Abuse and Ticket Protection

  1. The customer is required to protect tickets from loss, theft, misuse, and access by unauthorized third parties.
  2. The reproduction, alteration, or misuse of tickets is prohibited.
  3. Only the ticket that was first successfully validated at the entrance grants admission. In the case of duplicated, copied, or otherwise reused tickets, the right of admission applies exclusively to the holder of the ticket that was first successfully validated.
  1. The organizer has the right to block tickets that have been misused.

6. Resale

  1. The commercial resale of tickets requires the prior consent of RKV.
  2. The use of tickets for promotional, sweepstakes, marketing, or other commercial purposes also requires the prior consent of RKV.
  3. RKV reserves the right to block tickets sold in violation of these regulations.

7. Right of Withdrawal and Ticket Returns

  1. For contracts concerning the purchase of admission tickets for a specific date or time period, there is no right of withdrawal pursuant to Section 312g(2)(9) of the German Civil Code (BGB).
  2. Purchased tickets generally cannot be returned.
  3. In individual cases, RKV may allow a rebooking as a matter of goodwill. There is no legal right to this.

8. Loss of card

  1. Lost or damaged tickets generally do not entitle the holder to a replacement.
  2. RKV may issue replacement tickets at its discretion and after reviewing the booking information. A reasonable processing or service fee may be charged for this.
  3. There is no legal right to receive replacement tickets.

9. Changes to the Event, Cancellation, Termination, or Rescheduling

  1. The RKV reserves the right to cancel, suspend, terminate, or reschedule events for important organizational, technical, or safety-related reasons, as well as due to official orders or acts of God.
  2. Changes to individual program items, performers, attractions, exhibitions, or other event components generally do not constitute grounds for a return, exchange, or refund of tickets, provided that the overall nature of the event is not significantly altered.
  3. In the event of a cancellation, rescheduling, or interruption, the handling of tickets already purchased is governed by the applicable laws and the regulations announced by the organizer.

10. Customer's Duty to Provide Information

  1. The customer is required to follow the information and instructions provided during the booking process, on the tickets, in confirmation emails, and on the organizer’s website.
  2. Failure to review the information provided generally does not give rise to any claim for rebooking, a refund, damages, or other benefits.

11. Liability

  1. RKV has unlimited liability for damages resulting from death, bodily injury, or harm to health, as well as for damages caused by willful misconduct or gross negligence. 
  2. In the event of a breach of material contractual obligations due to slight negligence, liability is limited to the foreseeable damages typical for this type of contract.
  3. Furthermore, liability is excluded to the extent permitted by law.
  4. The foregoing limitations of liability also apply in favor of RKV’s legal representatives, employees, vicarious agents, and other representatives.
  5. The limitations of liability do not apply to claims under the Product Liability Act or other mandatory statutory grounds for liability.

12. Photographs, Films, and Audio Recordings

  1. During events, the organizer may take photographs, make video recordings, and record audio for documentation, reporting, and marketing purposes.
  2. The processing and publication of such recordings are carried out in accordance with applicable legal provisions.
  3. Further information can be found in the RKV Privacy Policy.
  4. Event-specific regulations apply to photography, filming, and audio recording by the customer. The respective terms and conditions of the event shall apply.

13. Data Protection

  1. Personal data is processed exclusively in accordance with applicable data protection laws.
  2. Information regarding data processing can be found in the RKV Privacy Policy.

14. Dispute Resolution

RKV is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Final Provisions

  1. The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
  2. If the customer is a merchant, a legal entity under public law, or a special fund under public law, Augsburg shall be the exclusive venue for legal proceedings.
  3. Should any provision of these Terms and Conditions be or become invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.

Visitor Guidelines for the Kaltenberg Knights' Tournament

1. Scope

  1. These visitor guidelines govern visits and stays on the grounds of the Kaltenberg Knights' Tournament.
  2. The General Terms and Conditions of Ritterturnier Kaltenberg Veranstaltungs GmbH (RKV) also apply to the purchase of tickets.

2. Weather and Climate

  1. The Kaltenberg Knights' Tournament is an outdoor event and generally takes place regardless of the weather.
  2. Rain, wind, heat, cold, and other weather-related disruptions to the visitor experience do not constitute grounds for rebooking, exchanging, or refunding tickets.

3. House Rules

  1. The organizer reserves the right to enforce its rules throughout the entire event grounds, including the visitor parking lots.
  2. You must follow the instructions of the staff, the admission personnel, the parking attendants, and the security personnel.
  3. The event organizer and the security personnel hired by the organizer are authorized to conduct bag searches, visual inspections, and personal searches at the entrance, as well as whenever there is a valid reason or concrete evidence to warrant such measures for the purpose of preventing danger.
  4. Visitors who refuse to undergo the required screenings may be denied access to the event grounds or removed from the event grounds. In such cases, there is no entitlement to a refund of the admission fee.
  5. The event organizer reserves the right to deny admission to the event grounds to anyone who is visibly intoxicated, under the influence of drugs, or otherwise noticeably impaired.
  6. Visitors who disrupt the event, endanger or harass other guests, compromise the safety or order of the event, behave inappropriately due to alcohol or drugs, fail to follow staff instructions, or violate these terms and conditions of admission may be removed from the event grounds and the associated visitor parking lots without being entitled to a refund of the admission fee.
  7. The organizer, the security personnel it has hired, the parking lot attendants, parking lot attendants, and any other persons responsible for visitor guidance and parking lot management are authorized to deny access to visitor parking lots to vehicles without a valid ticket, as well as to restrict or prohibit access to the extent necessary to ensure sufficient parking capacity for visitors with valid tickets.
  8. In the event of removal from the event grounds, denial of access, or denial of entry due to a violation of these Terms and Conditions of Attendance, there shall be no entitlement to a refund of the admission price, compensation, or damages, to the extent permitted by law.
  9. The organizer is entitled, for safety reasons, due to official orders, or to prevent danger, to order attendees to leave the event grounds and to temporarily or permanently close off individual areas. To the extent permitted by law, this shall not give rise to any claims for a refund of the admission price, substitute services, or damages.

4. Animals

  1. Dogs and other animals are generally not permitted on the event grounds. This is to ensure compliance with the event’s specific safety requirements and to maintain orderly proceedings.
  2. Exceptions are made for legally recognized service dogs and guide dogs. Proof that a dog is a service dog or guide dog must be provided upon request by the event organizer or security personnel through appropriate documentation. Service dogs and guide dogs must be clearly identified as such while on the event grounds and must wear an appropriate harness or comparable identification.
  3. The organizer notes that the Kaltenberg Knights’ Tournament may be particularly stressful for service dogs and guide dogs due to large crowds, loud noises, music, pyrotechnic effects, the presence of animals, and other factors typical of such events. Therefore, bringing a dog to the event is generally not recommended.
  4. Leaving animals in vehicles in the visitor parking lots or other areas of the event is prohibited.
  5. The organizer is authorized to notify the appropriate authorities in the event of any violations and to take the necessary measures to protect the animals.

5. Weapons, Dangerous Items, and the Ban on Face Coverings

  1. Carrying weapons, imitation weapons, prop weapons, and any other items not expressly authorized by the event organizer is prohibited throughout the entire event grounds.
  2. This applies in particular to dangerous tools, knives, pepper sprays, pyrotechnic devices, and similar items, regardless of their name or intended use.
  3. The only exceptions are participants, performers, and groups who are contractually bound to the organizer and have personalized, explicit authorization from the relevant district administration office.
  4. Medieval attire and costumes are welcome.
  5. Masks, face coverings, or costumes that completely cover the face or prevent a person from being identified are not permitted anywhere on the event grounds.
  6. In case of uncertainty regarding whether an item is permitted, the organizer or the security personnel appointed by the organizer will make the final decision.

6. Smoking

  1. Smoking is not permitted in the arena seating areas or in the box seats.
  2. Smoking is permitted in the open spaces, standing areas, and other outdoor areas not specifically designated as non-smoking, provided that no laws or regulations prohibit it.

7. Prohibited Items

  1. Glass bottles and other glass items. This excludes glass containers for baby food.
  2. Camping chairs, fishing stools, garden chairs, and similar seating. 
  3. Handcarts, transport carts, and similar transport aids. Strollers are not included in this restriction and are expressly permitted.
  4. Bicycles, scooters, skateboards, inline skates, and similar modes of transportation. This excludes medically necessary assistive devices and mobility aids for people with disabilities.
  5. Bringing alcoholic beverages onto the event grounds is not permitted.

8. Umbrellas

  1. Umbrellas and sunshades may generally be used on the event grounds.
  2. In the arena, the spectator stands, and other seating areas, umbrellas may not be opened if they obstruct the view of other visitors.

9. Liability

  1. Visitors enter the event grounds at their own risk.
  2. Parents, legal guardians, and other supervising adults are responsible for the children entrusted to their care throughout their entire stay and must fulfill their duty of supervision without restriction.
  3. Parents, legal guardians, and other supervising adults must take special care to ensure that children do not enter restricted areas, do not climb on exhibits, railings, fences, decorative elements, or other fixtures, and do not remain unsupervised in areas that are clearly not intended for play or entry.
  4. Seating, decorative items, exhibits, fences, railings, barriers, and other facilities located on the event grounds may only be used for their intended purpose. Climbing on them, playing on them, or using them in any other manner inconsistent with their intended purpose is prohibited.
  5. Damage caused by visitors or children under their supervision is subject to the statutory liability provisions.
  6. The organizer reserves the right to remove visitors from the event grounds in the event of violations of the above-mentioned rules or failure to follow staff instructions. In such cases, there is no entitlement to a refund of the admission fee.

10. Photographs, videos, and audio recordings taken by visitors

  1. Private photography and video recording for personal and noncommercial use are generally permitted.
  2. The following are not permitted:
    • extended or complete recordings of variety shows, performances, or presentations,
    • commercial photography, film, or audio recordings without prior authorization,
    • Cameras, including the attached lens, with a total length of more than 25 cm,
    • Tripods, monopods, and selfie sticks,
    • Other equipment that obstructs the view of other visitors.
  1. The determining factor in classifying a recording as private or commercial is its purpose, not the equipment used.
  2. Sharing personal photos and short video clips via private and non-commercial social media channels is permitted.
  3. Photographs, films, and audio recordings for commercial, editorial, journalistic, promotional, or other professional purposes require the prior written consent of the organizer.
  4. The event organizer and security personnel are authorized to inspect any photography and video equipment brought to the event.
  5. In the event of violations of these regulations, the organizer may prohibit the use of such devices, deny admission, or remove visitors from the event grounds. In such cases, there is no entitlement to a refund of the admission fee.

11. Final Provisions

  1. The laws of the Federal Republic of Germany apply.
  2. If any provision of these Terms of Use is or becomes invalid or unenforceable, in whole or in part, the validity of the remaining provisions shall remain unaffected. 
  3. The invalid or unenforceable provision shall be replaced by the applicable statutory provisions.
