General Terms and Conditions of Ritterturnier Kaltenberg Veranstaltungs GmbH for ticket bookings

The following terms and conditions apply to all contracts and orders placed for the sale of admission tickets (hereinafter referred to as "tickets") by Ritterturnier Kaltenberg Veranstaltungs GmbH (hereinafter referred to as RKV) using the ticket machine operated by Net-Up AG (Dachauer Str. 272, 80992 Munich).

1. General terms and conditions

  1. RKV offers its customers the opportunity to purchase tickets in accordance with these General Terms and Conditions. With print@home tickets, the user has the option of printing the tickets immediately after the ordering process; otherwise, the tickets will be sent by mail or deposited at the box office. Ritterturnier Kaltenberg Veranstaltungs GmbH is only partially the organizer of the events offered. The contractual relationship with regard to the event and the sale of tickets is established exclusively between the ticket purchaser and the respective organizer. In this respect, RKV acts, if not the organizer itself, exclusively as a commercial agent on behalf of and for the account of the respective organizer.


2. Conclusion of contract

  1. Online:
    The offer to conclude a contract is made by the customer as soon as they trigger a ticket booking subject to payment by clicking on the "Order and pay" button. TicketMachine then checks again whether the number of tickets ordered in the selected price category is still available. The offer is accepted by sending a booking confirmation by email to the email address provided by the customer. After successful payment, the customer receives a payment confirmation by email and, in the case of print@home orders, the tickets as a PDF file; otherwise, the tickets are sent by post.
  2. Offline:
    The offer to conclude a contract is made by the customer as soon as they confirm a ticket booking subject to payment by telephone or at the ticket office. RKV then checks again whether the number of tickets ordered in the selected price category is still available. The offer is accepted by postal delivery or direct handover of the tickets after receipt of payment.
  3. If the desired number of tickets in the selected price category is no longer available, the customer will be notified during the booking process and no contract will be concluded.
  4. The user of the ticket may differ from the purchaser and account holder, provided that the ticket has been legally transferred to them by the purchaser.
  5. In addition to the ticket price, a shipping and/or handling fee may be charged per order for shipping or deposit. This will be indicated accordingly during the ordering process.
  6. RKV is entitled to cancel a binding order placed by the customer (unilateral right of withdrawal) if the customer violates the terms and conditions set by RKV or the respective event organizer, or if payment is not made within a reasonable period of time despite a payment reminder.


3. Conclusion of contract

  1. Customers can pay online by credit card (Mastercard, Visa, American Express), PayPal, or SEPA direct debit.
    For telephone orders, credit cards (Mastercard, Visa, American Express), SEPA direct debit, or invoice are accepted as payment methods.
    At the box office, credit cards (Mastercard, Visa, American Express), EC cards, and cash are accepted as payment methods.
  2. Payment by credit card is made immediately, by PayPal within one banking day.
  3. When paying by SEPA direct debit, the customer authorizes RKV to collect a one-time payment from their account using SEPA core direct debit. At the same time, they instruct their bank to honor the direct debit for RKV. The SEPA advance notification will be sent by email after receipt of the order. The payment amount will be collected no earlier than 2 days after receipt of the order. The customer must ensure that there are sufficient funds in the account. Costs incurred due to a chargeback of the direct debit shall be borne by the customer (currently €5.00), unless the customer is not responsible for the chargeback.
  4. RKV undertakes to use the payment data exclusively for the purpose of collecting payments.
  5. Tickets will be sent by RKV at the customer's expense (see above for shipping fees) and risk. RKV reserves the right to choose the shipping company at its own discretion.
  6. The tickets will be sent to the customer as soon as possible after successful payment (by email or post). The customer is obliged to contact RKV if they have not been able to print or receive the purchased tickets within 2 weeks of placing the order. The customer may set RKV a reasonable grace period. After the grace period has expired, they may withdraw from the order/contract by written declaration, unless the goods have already been shipped in the meantime.
  7. For individual events, tickets can be reserved at the box office. These tickets must be paid for in advance. Once payment has been made, the order is binding and cannot be canceled. If the tickets are not used or collected, the purchase price cannot be refunded.
  8. Upon receipt of the tickets, the customer is obliged to check them for correctness in terms of number, price, date, time, event, and venue. The customer can check their original customer order on the Internet.
    Complaints about incorrect tickets must be made immediately (i.e., within 5 working days) after receipt of the shipment or after printing print@home tickets. Complaints must be made in writing, either by email to [email protected] or by post to RKV, Schloßstr. 10, 82269 Geltendorf, Germany.
  9. The postmark or the date of the email transmission log is decisive for compliance with the complaint period. If you have any questions, please contact the RKV telephone service at 01806 11 33 11.


4. Returned direct debits and chargeback credit card payments

  1. If the customer or their bank cancels the payment, the customer will receive a payment request by mail or email. If no payment is made within the specified period, RKV is entitled, but not obliged, to withdraw from the purchase contract as the organizer or on behalf of the organizer and to block the tickets. In this case, RKV retains the right to payment of the contractually owed advance booking, system, service, and shipping fees.


5. Special conditions for tickets

  1. The customer must ensure that the barcode printed on the ticket is in perfect condition. In particular, it must be protected from creasing, soiling, and moisture.
    The specific barcode on the ticket is invalidated when the ticket is scanned for the first time upon arrival at the event.
  2. The reproduction and manipulation of printed tickets is not permitted.
    The customer is obliged to keep the ticket safe from reproduction by third parties.
    RKV reserves the right to demand payment of the total value of the reproduced tickets and compensation for any damages from customers whose tickets have been reproduced without authorization due to their own fault or consent.
  3. RKV accepts no responsibility for any inconvenience and/or damage caused by unauthorized reproduction or misuse of tickets. If the customer misuses the ticket, they will not be entitled to admission.


6. Resale

  1. The commercial resale of tickets is only permitted with the express consent of RKV.


7. Ticket return

  1. Purchased tickets cannot be returned or exchanged. Consumers do not have a right of withdrawal for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services (Section 312g (2) sentence 1 no. 9 BGB). This means that every ticket order is binding immediately after confirmation of the order by RKV and obliges the customer to accept and pay for the tickets ordered in accordance with the existing regulations.
  2. No replacement will be provided for expired cards.
  3. Changes to the program schedule and other changes do not entitle ticket holders to a refund.


8. Loss of card

  1. Replacement tickets for tickets lost or destroyed by the customer can be issued at the box office for a processing fee. Print@home tickets sent by email can also be reprinted by the user.


9. Cancellation, failure, or postponement of the event

  1. If the event is canceled, the admission fee will only be refunded if less than half of the arena program has been played at the time of cancellation and there are no circumstances of force majeure. The right to a refund expires if it is not claimed within 5 days. Other organizers may have different regulations.
  2. Refunds will only be issued upon presentation of the tickets. No refunds will be given if the tickets are lost.
  3. If events are rescheduled, the ticket remains valid unless the organizer announces a different policy.
  4. If the event is canceled due to the coronavirus pandemic or similar circumstances, a replacement date will be arranged for which the tickets will then be valid.
  5. Contractual relationships are established exclusively between the ticket purchaser and the event organizer. Even if RKV is not the event organizer itself, it will inform ticket purchasers of any postponements or cancellations via a notice on its website and, if necessary, by email.


10. Limitations of liability

  1. Upon request, the customer will be registered and a password created. The user is responsible for ensuring that no unauthorized third parties gain knowledge of their password. The user is liable for any misuse.
  2. If RKV is not the organizer itself, it is not liable for the content, implementation, course, or quality of the event. In particular, RKV accepts no liability for the accuracy of information provided by other organizers, insofar as this information is published on the RKV website or TicketMachine.
  3. RKV accepts no liability for the cancellation, termination, postponement, or repetition of an event due to force majeure, even if such cancellation, postponement, repetition, or termination of an event is to the detriment of the customer and his/her guest(s). Consequently, no claims for compensation or damages can be asserted against the above-mentioned legal entities in this regard.
  4. In any case, RKV shall be liable without limitation under the Product Liability Act for damages caused intentionally or through gross negligence, for fraudulent concealment of defects, and for damages resulting from injury to life, limb, or health. Liability for damages resulting from the breach of a warranty shall also be unlimited.
  5. In the event of a breach of essential contractual obligations (so-called cardinal obligations) based solely on simple negligence, RKV's liability shall be limited to compensation for foreseeable damage typical for this type of contract.
  6. Except in the cases mentioned in paragraphs 10.4 and 10.5, RKV shall not be liable for damages caused by simple negligence.
  7. The customer's right to withdraw from the contract due to a breach of duty for which RKV or another organizer is not responsible and which does not consist of a defect in the goods is excluded.
  8. Insofar as RKV's liability is excluded or limited in accordance with the above paragraphs, this also applies to the liability of its vicarious agents and assistants.


11. Privacy policy

  1. The TicketMachine used by RKV for online ticket purchases employs a secure transmission method. All data transmitted by the customer is processed in compliance with the data protection regulations applicable to the transaction and storage.
  2. If the customer gives their consent when registering, personal data will be used not only to process the order but also to inform the customer about further offers from RKV via newsletter. The customer can revoke their consent at any time.


12. Law

  1. Should individual provisions/sub-clauses of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
  2. The applicable law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Munich.
  3. The sole place of performance for delivery, service, and payment is Kaltenberg.
  4. If both contracting parties are merchants, the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Augsburg.


13. Image and sound recordings

  1. Ticket holders attending an RKV event acknowledge and agree that their voices and images in the form of photographs and still images, as well as in audio, visual, and/or audiovisual material recorded or captured during their attendance at an event, may be used by RKV free of charge. This use may take place simultaneously or at a later date, regardless of whether the recording is captured or stored in the form of images, audio transmissions, video, audiovisual or any other form.
  2. It is prohibited to record, use, or transmit audio and/or video material, recordings, or descriptions of the event via the Internet, radio, television, or other current or future media for purposes other than private use, or to assist other persons in carrying out such activities.
